JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Darauli P.S. Case No. 41 of 2019, disclosing offences under Sections 341, 323, 337, 338, 324, 307, 504, 447, 506, 354, 379 and 34 of the Indian Penal Code. Allegation as per F.I.R. is that while the informant was taking tea at his door, his neighbour came and told that one Rajendra Sharma and his sons are abusing his wife and son, when he reached there, he saw that accused persons including the petitioner were abusing and assaulting his wife and when he tried to intervene in the matter, it is alleged that this petitioner assaulted by Sword and there is also allegation against other accused persons of assault. There is allegation of other accused persons that they have also assaulted the informant and others. Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Siwan, in connection with Darauli P.S. Case No. 41 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
