JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Panapur P.S. Case No. 101 of 2013 registered for the offences punishable under Sections 272, 274 of the Indian Penal Code and 47 A of the Excise Act.
Admittedly, name of petitioner came in this case on the basis of disclosure made by wife of one Bachha Singh but submission on behalf of the petitioner is that the statement of wife of Bachha Singh is apparently incorrect because Annexure-2 to this petition reveals that one Sunil Kumar Singh had taken room on rent from the above stated Bachha Singh.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is
Patna High Court Cr.Misc. No.7577 of 2015 (2) dt.03-03-2015 allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Singh, Judicial Magistrate 1st Class, Saran at Chapra in Panapur P.S. Case No. 101 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
