ANJANA MISHRA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioners, learned counsel for the informant and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Gaunaha P. S. Case No. 143 of 2015 registered for offence punishable under Sections 147, 148, 149, 323, 338, 307 and 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that there are general and omnibus allegations against the entire family members of petitioners having assaulted the brother of the informant on his head and whole body by means of danda, resulting in his death. The present petitioners are the female inmates of the family.

Patna High Court Cr.Misc. No.2399 of 2016 (4) dt.21-04-2016 2/2 Considering the facts and circumstances, it appears that there is no specific allegation against the petitioners. It also appears from perusal of the F.I.R. that all family members of the petitioners have been made accused in this case due to previous enmity.

Considering the aforementioned facts and circumstances that the petitioners have no criminal antecedent, let the petitioners namely, Sharda Devi, Manju Devi, Usha Devi @ Asha Devi, and Puja Devi in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/ production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gaunaha P.S.Case No. 143 of 2015, subject to condition as laid down under Section 438 (2) of Cr. P.C. (Anjana Mishra, J) Sudha/- U T
