The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 147, 341, 323, 324, 307 and 504 of the Indian Penal Code. It is alleged against the petitioner that the petitioner on the order of co-accused Awani Mallik assaulted the informant with sickle on the head.

It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of land dispute. The injury has been found superficial simple in nature and there is a counter case being Manihari P.S. Case No. 288 of 2016 lodged with the accusation

Patna High Court Cr.Misc. No.60090 of 2017 (2) dt.12-12-2017 2/2 for the offences punishable under Sections 448, 147, 341, 323, 307, 354, 504 and 506 of the Indian Penal Code. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the nature of injury and the counter version of the occurrence, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S. Case No. 287 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
