The petitioner seeks bail in Majhauliya P.S. Case No. 273 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that the petitioner repeatedly assaulted his son Munna Kumar with knife.
Submission is that the occurrence is of 17.08.2014, but the FIR was lodged on 18.08.2014. There is inordinate delay in lodging the case. The petitioner is in jail since 19.08.2014. It appears that it was the petitioner who repeatedly assaulted Munna Kumar with knife and the knife was broken inside. The doctor has opined the injury to be grievous in nature.
Patna High Court Cr.Misc. No.4571 of 2015 (4) dt.03-04-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail at this stage. Accordingly, the same is rejected.
The petitioner may renew his prayer for bail after remaining one year in jail.
