One country made automatic pistol containing eight live cartridges are said to have been recovered from conscious possession of the petitioner when petitioner and others assembled to make preparation for committing dacoity.

Petitioner carries criminal antecedent of three cases but in the present case, having more or less similar allegation, some coaccused have already been granted privilege of bail by this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Town P.S.
