Petitioner seeks bail in Sessions Trial No.432 of 2012/79 of 2014 arising out of Madanpur P.S.Case No.183 of 2012 registered for the offence under Section 302 and other sections of the IPC.
The petitioner is alleged to have killed his wife by pouring kerosene oil on her body and children by fire. The informant was the wife of the petitioner and she had narrated the entire story. The informant died during the course of treatment. It is submitted that the petitioner is in jail since 8.8.2012 but only four witnesses have been examined but they did not support the prosecution story.
It appears that there is specific allegation against the petitioner that he burnt his wife by pouring kerosene oil on her body and she died due to burn injuries.
Considering the facts and nature of allegation, I am not inclined to enlarge the petitioners on bail and accordingly, the
Patna High Court Cr.Misc. No.7061 of 2015 (3) dt.15-04-2015 same is rejected.
The trial court has reported that the trial is likely to be concluded within nine months. Accordingly, the trial court is directed to conclude the trial within nine months from the date of receipt or production of a copy of this order. The Superintendent of Police, Aurangabad is directed to make all efforts to produce the prosecution witnesses before the trial court on the dates fixed so that the trial must conclude within nine months.
