====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-01-2022 Heard learned counsel for the petitioners and learned APP for the State.

Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 504, 307, 506/34 of the Indian Penal Code.

No.4452 of 2021(3) dt.05-01-2022 2/3 It is alleged that all the accused persons including the petitioners came at the door of the informant with lathi, iron rod, spade, sword and spear and started assaulting the informant and other family members, as a result of which, the informant sustained injuries on his head and left hand. The accused persons also assaulted Rambabu Yadav on his head as a result of which, he fell on the ground and became unconscious and when Rajiya Devi came to rescue, she was also assaulted on her head. It is alleged that petitioner No. 2 snatched gold chain from Rajiya Devi. The accused persons also taken away cash of Rs. 10,500/- and threatened of dire consequences.

It is submitted by learned counsel for the petitioners that the accusation against the petitioners is general and omnibus. It is further submitted that there is a land dispute between the parties. Moreover, the injuries of the informant and Rajiya Devi were found to be simple in nature. A statement has been made in para

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur(Tehta) P.S. Case No. 169 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
