2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 341, 323, 354(B), 354(D), 509, 427, 506, 34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of occurrence, petitioner is alleged to have attempted to molest the informant.

4. Learned counsel appearing for the petitioner submits that a dispute arose on account of over taking the motorcycle. The motorcycle of the petitioner was dashed by the scooty of the brother of the informant and thereafter this false case been lodged by the informant. As a matter of fact, no such occurrence has narrated in the F.I.R. has taken place and only to

Patna High Court CR. MISC. No.50753 of 2024(2) dt.12-07-2024 2/2 exert pressure on the petitioner, this false case has been lodged. Petitioner has one criminal antecedent and he is on bail in that case. Petitioner is in custody since 23.05.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts of the case, period of custody, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P.S.
