JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present occurrence took place in the year, 2006 in which, two persons were killed but the petitioner could be remanded in this case on 15-05-2014 and since then, he is languishing in jail custody.

Learned counsel, appearing for petitioner submits that having more or less similar allegation, several co-accused have already been granted privilege of bail and as a matter of fact, petitioner voluntarily, surrendered before the administration. The impugned order shows that altogether four prosecution witnesses have already been examined. No doubt, some of the co-accused have been granted

No.2952 of 2016 (3) dt.25-02-2016 2/2 privilege of bail by different benches of this court but in my view, taking note of criminal antecedent of the petitioner as well as stage of trial, it is not desirable to release the petitioner on bail at least, at this stage and accordingly, his prayer for bail in connection with Piparasi P.S. Case No. 17 of 2006 corresponding to Sessions Trial No. 381 of 2014 pending in the court of learned Additional Sessions Judge-III, Bagaha, West Champaran stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/production of copy of this order.
