Petitioner is not named in the first information report but in course of investigation, Investigating officer came to know that one person was apprehended by the villagers and stolen motorcycle was recovered in front of a mosque. It is alleged that at the time of the aforesaid recovery the above stated motorcycle was being used by the petitioner.

Taking note of the aforesaid facts as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Vaishali P.S.
