The petitioner apprehends his arrest in connection with Muffasil P.S. Case No.149 of 2017 registered under Sections 25(1-A) (1-AA), 25(1-AC), 25(1-b)A, 26 (i)(ii) and 35 of the Arms Act.

The accusation is that in course of raid of the house of Bharat Sharma in village-Taukir Terasi, semi manufactured pistol, magazine and other parts of the gun and pistol were recovered. Bittu Kumar and Md. Shakim were apprehended from there. At that time, Bittu Kumar disclosed that Amir Yadav, Akhilesh Yadav and this petitioner used to help in manufacturing of the

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has come in the confessional statement of the co-accused Bittu Kumar. While the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, but in one case, he has been acquitted and in another case, he is on bail. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Munger, in connection with Muffasil P.S. Case No.149 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. Out of the two sureties, one must be either parents or close relative of the petitioner.
