Petitioner no. 1 was driver whereas petitioner no. 2 was Khalasi of the truck and according to the prosecution case itself, it was petitioner no. 1, who gave information to the informant in respect of missing of the truck, whereas petitioner no.2 disclosed that he along with petitioner no. 1 had gone to take meal in a hotel and when they returned, they found that the truck was missing. In course of investigation, I.O went at Gautam Hotel and the owner of the aforesaid hotel verified this fact that on the alleged date of occurrence, petitioners had come to his hotel to take meal. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna city, Patna, in connection with Agam Kuan P.S.Case No. 439 of 2015.
