The petitioner seeks pre-arrest bail in connection with Kargahar P.S. Case No. 194 of 2017 registered under Sections 406, 409 and 420 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that all the works were completed according to the schemes estimated but due to political rivalary between the Ex-mukhiya and the present Mukhiya, the FIR has been instituted. He submitted that three other co-accused, namely, Manoj Kumar @ Manoj Kumar Singh, Deen Bandhu Pathak @
Patna High Court Cr.Misc. No.51199 of 2017 (2) dt.17-11-2017 Din Bandhu Pathak and Ravindra Kumar Singh @ Ravindra Kumar @ Ravindra Singh have already been granted pre-arrest bail vide different orders passed by different Benches of this Court.
Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. However, he admitted that three other co-accused having identical allegation have already been granted pre-arrest bail by this Court.
Having regard to the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 194 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
