Petitioner was neither caught on the spot nor anything was recovered from her conscious possession and name of the petitioner came in this case in the confessional statement of co-accused who was caught on the spot.

Moreover, one co-accused Sanjay Sahni, who was caught on the spot, has already been granted privilege of bail. So far as petitioner is concerned, she is in jail custody since 9.9.2015 without having any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, Muzaffarpur in Hathauri P.S. Case no. 101/2015. shahid (Hemant Kumar Srivastava,J) U T
