1. The present writ petition has been filed seeking the following relief(s):- "1(i) For issuance of writ/s, order/s, direction/s in the nature of mandamus commanding the Respondents, to immediately pay the dues of arrears after deduction from the Account of Respondent No. 9 and also pay half of the pension to the petitioner with effect from 2022. (ii) For issuance of writ/s, order/s, direction/s in the nature of mandamus to also pay the

Patna High Court CWJC No.11353 of 2023(2) dt.30-07-2024 2/2 family pension to the petitioner. as per the order dated 25.06.2019 passed by the learned Principle Judge Family Court, Darbhanga in Maintenance Case no. 38 of 2010.

(iii) For further directed to the concerned respondent authorities to pay the reasonable panel interest amount over the entire dues of the petitioner from the date of entitlement to till the date of payment."

At the outset, the learned counsel for the petitioner submits that in view of the order dated 08.05.2023, passed in the earlier writ petition, filed by the petitioner i.e. the one bearing CWJC No.13239 of 2022, the petitioner has already availed the requisite alternative remedy, available to her, hence she be granted liberty to prosecute the same. Liberty so sought is granted.

3. The writ petition stands dismissed.
