1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Maharajganj Police Station Case No. 130 of 2024, dated 10.04.2024, disclosing offences under Section 394 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 09.04.2024, at about 7:10 PM in the night, when the informant was returning home on his motorcycle and as he reached near Chewar of Nerua village, three unknown accused persons riding on a Passion Pro motorcycle surrounded the informant from front side. The accused persons, aged about 20-25 years, were having knife in their hands and one accused person was armed

Thereafter, all the accused persons snatched informant's motorcycle and mobile, aadhar card and some money. When, the informant protested, one accused person gave knife blow due to which he received knife injuries on his left shoulder and on chest.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He next submits that the petitioner is not named in the F.I.R. and during the course of investigation his name has transpired in this case on the basis of the confessional statement of co-accused, Anu Kumar Kushwaha, and except the confessional statement of coaccused, there is nothing on record to demonstrate the complicity of the present petitioner with the alleged occurrence. He further submits that the similarly situated co-accused person Setu Kumar Pandey @ Kundan Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 83678 of 2024, dated 11.12.2024.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the

Patna High Court CR. MISC. No.49113 of 2025(2) dt.12-08-2025 3/3 similarly situated co-accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Siwan, in connection with Maharajganj Police Station Case No. 130 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
