JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2279C of 2016, registered for the offences punishable under Sections 498A of the Indian Penal Code and Section 4 of D.P. Act.

In this case earlier notice has been issued to Opposite Party No.2. Since the case is under Section 498A of the I.P.C. However, service report has been received which disclosed that O.P. No.2 has fled away with some other person and she is not resides there.

Allegation against the petitioner is of demand of dowry and torture and also tried to kill her. Submission of the learned counsel for the petitioner

Patna High Court CR. MISC. No.44385 of 2019(5) dt.22-10-2019 2/2 is that the whole allegation is false and concocted and marriage was solemnized 12 years ago and thereafter complainant is not ready to reside with the petitioner as such the present case has been filed.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M.. Bettiah, West Champaran in connection with Complaint Case No.-2279C of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
