JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since11.11.2014 in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offence Act 2012.

It is alleged that the petitioner started taking the minor daughter of the informant towards garden by holding her hand. On alarm being raised, the petitioner escaped from the scene though he received injuries.

It is submitted by the learned counsel for the petitioner that only on suspicion, the accused has been implicated and the allegation does not constitute offence under Section 376/511 of the IPC. A statement has been made in para 3 of the petition that the

Patna High Court Cr.Misc. No.8480 of 2015 (2) dt.04-03-2015 2/2 petitioner has no criminal antecedent.

Considering the facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Bangariya (Turkauliya) P.S. Case No. 784 of 2014.
