JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The first information report of present case was lodged against F.I.R. named accused Gaurav Rai against whom there is allegation that he shot fire on the deceased, but after nine days of the institution of the F.I.R., a protest petition was filed in which it is stated that one unknown person was also present along with coaccused Gaurav Rai and the said unknown person facilitated the main accused to flee from the place of occurrence. In course of investigation, witnesses claimed that it was petitioner who was also present near the place of occurrence and after the occurrence, he as well as F.I.R. named accused Gaurav Rai fled away by the

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manjoor Alam, A.C.J.M. III, Rosera, Samastipur in connection with Bibhutipur P.S. Case No.115 of 2013.
