JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-04-2016 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Section 22 and 23 of the NDPS Act.

Though, the earlier bail application of the petitioner was rejected by a co-ordinate Bench of this Court with a liberty to renew prayer for bail after remaining in custody for one but the matter has been placed under the heading 'For Admission' before this Court in view of the administrative order of Hon'ble the Acting Chief Justice dated 07.04.2016 since the concerned Bench is not available due to medical exigency.

From the house of the petitioner 18 kgs of ganja were recovered.

It is submitted by learned counsel for the petitioner that the recovery of contraband is between small and commercial

No.3033 of 2016 (2) dt.08-04-2016 2/2 quantity and in view of the observation made by this Court while rejecting the earlier prayer for bail, the petitioner has completed one year in custody as he is in custody since 14.12.2014. Moreover, a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the recovery of contraband between small and commercial quantity, the liberty given by the co-ordinate Bench of this Court to renew prayer for bail after remaining in custody for one year and statement made in para 3 of the petition that the petitioner has no criminal antecedent, let the petitioner be released on bail on furnishing the bail bonds of Rs. 10,000/- (ten thousands) with two sureties of like amount each to the satisfaction of learned District and Sessions Judge-cum-Special Judge, NDPS Act, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 720 of 2014.

Learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in similar nature of offences. (Dinesh Kumar Singh, J) Amrendra/- U T
