Petitioner seeks bail in a case under Sections 392 of the Indian Penal Code which lateron converted into section 395 and 412 of the Indian Penal Code..

The petitioner is not named in the first information report but his name figured in the confessional statement of co-accused Rahul Kumar Yadav. Nothing incriminating has been recovered from the possession of the petitioner and he was not put on test identification parade. Except confessional statement of co-accused, there appears no evidence against the petitioner.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 5th Additional Sessions Judge, Munger in connection with Jamalpur P.S.Case No. 84 of 2014 (S.Tr.No.953 of 2014).
