No doubt, petitioner is named in the first information report but according to the prosecution case itself, alleged occurrence took place on account of land dispute and it was co-accused Smarat Singh who opened fire on the deceased at the instigation of co-accused Pravin Singh @ Chakori and Tantan Singh and, therefore, if the participation of the petitioner in the alleged crime is assumed to be true, then also, he was only a member of unlawful assembly. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Begusarai Mufassil (Singhaul) P.S.
