JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Baheri P.S. Case No. 50 of 2017, registered under Sections 363, 366 and 366(A) of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant by Md. Sunna with the help of both petitioners. Learned counsel for the petitioners submits that both petitioners are married sister and married cousin sister of coaccused, Md. Sunna, and they have falsely been implicated in this case mere on suspicion. In fact, the victim, daughter of the informant, has stated in her statement under Section 164 Cr.P.C. to the effect that she was kidnapped by Md. Sunna, but not disclosed the name of both petitioners having hand in her kidnapping.
Patna High Court Cr.Misc. No.62618 of 2017 (2) dt.21-12-2017 Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S. Case No. 50 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
