The petitioner is accused in connection with Sahebganj P.S. Case No. 189 of 2014, registered under Sections 364, 365, 367, 326 and 307 of the Indian Penal Code. The accusation is that six accused including petitioner named in the complaint petition, which is the basis of the F.I.R., abducted and assaulted the complaint/informant Alok Kumar.

Learned counsel for the petitioner submits that, in fact, informant/complainant sustained injury in road accident, but after treatment, the complainant/informant lodged Complaint Petition No. 599 of 2014 after 26 days of the occurrence, which is the basis of the F.I.R. Further submission is that the

No.2991 of 2016 (3) dt.18-03-2016 2/2 independent witnesses in paragraph no. 10 of the case diary stated about sustaining injury by the complainant/informant in road accident. The petitioner has got no criminal antecedent and he is in custody since 24.09.2015. The similar situated coaccused, Ram Babu Rai and Md. Nazir @ Md. Najir have already been granted privilege of bail by a coordinate Bench of this Court vide order dated 09.03.2016 passed in Criminal Misc. No. 6100 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., West Muzaffarpur in connection with Sahebganj P.S. Case No. 189 of 2014.
