JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-01-2016 Heard learned counsel for the petitioner and learned counsel, appearing for CBI.
Petitioner happens to be an employee of ECIBJCL(JV) and accusation against the petitioner as well as other accused is that they, having entered into criminal conspiracy, caused loss to the government to the tune of more than Rs. 13,000,00/- (thirteen lacs) by got clearing the fake bills. Contention on behalf of the petitioner is that petitioner was authorized by the company to collect cheque and he was not involved in the measurement of earth work rather it were engineers, who did the aforesaid work and the concerned engineers have already been granted privilege of bail by different benches of this court. It is further pointed out by him that
Patna High Court Cr.Misc. No.1907 of 2016 (2) dt.28-01-2016 2/2 according to prosecution case itself, the forged signatures of employees of the companies were found on the measurement report and moreover, while disposing of the anticipatory bail application of the petitioner, a coordinate bench of this court noticed that the petitioner has a good case for grant of regular bail, if, his presence in course of trial is secured. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with RC 12A/2011 giving rise to Special Case No. 08 of 2011 to the satisfaction of learned Special Judge, CBI-III, Patna subject to condition that one of the sureties must be local and holder of landed property.
