2. The petitioner apprehends his arrest in connection with Baisi P.S. Case No. 300 of 2020, instituted under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41/ 47 of the Bihar Prohibition & Excise Act.

3. There is recovery of 20.860 litre foreign liquor from the Scooty of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Co-accused Shyam Kumar Sah, who is brother of the petitioner had taken the vehicle for his personal work. Petitioner has no concern with the seized liquor. Petitioner lives in Himachal Pradesh. Except that the petitioner is registered owner

Patna High Court CR. MISC. No.46374 of 2025(2) dt.30-07-2025 2/2 of the seized vehicle, there is no material against the petitioner. Petitioner has no criminal antecedent. Petitioner undertakes to co-operate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise No. I, Purnea in connection with Baisi P.S. Case No. 300 of 2020, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
