JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-07-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Pawana P.S. Case No. 27 of 2021, registered for the offences punishable under Sections 420 & 406 of the Indian Penal Code. As per allegation, Rs. 16,50,000/- was sanctioned to the petitioner for the work of Nal Jal Yozana. However, according to measurement work of only Rs. 10,00,000/- was completed. Learned counsel for the petitioner has submitted that the petitioner is a ward member. He has submitted further that after lodging of the FIR the entire work as mentioned in the FIR has been completed and this fact has mentioned in the ordersheet dated

Patna High Court CR. MISC. No.58043 of 2021(2) dt.05-07-2022 2/2 17.12.2020 in Complaint No. 999960106032062811 dated 06.03.2020.

The above-mentioned ordersheet has been annexed as Annexure-2. From perusal thereof it appears that entire work has been completed.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Pawana P.S. Case No. 27 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
