The petitioner seeks bail in Bounsi P.S. Case No. 25 of 2014, registered for the offences punishable under Sections 365 and 364 of the Indian Penal Code.

The informant named Md. Shahid Ali and Md. Rizwan and alleged that they along with others kidnapped Jharun Paswan. The petitioner is not named in the FIR. The name of the petitioner figured in the case in the statement of Jharun Paswan who recorded her statement under Section 164 of the Cr.P.C. Jharun Paswan alleged that the petitioner along with others kidnapped him and his wife and confined them in a room from there they were let out after 5-6 days.

Learned counsel for the petitioner submits that similarly

Patna High Court Cr.Misc. No.10903 of 2015 (2) dt.18-03-2015 2/2 situated accused Amrulla @ Abdul and Anr. have already been enlarged on bail vide order passed in Cr. Misc. No. 45692 of 2014 on 11.02.2015 and the case of the petitioner stands on same footing.

Considering the facts aforesaid and the fact that the similarly situated accused have already been enlarged on bail, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Bounsi P.S. Case No. 25 of 2014.
