The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 354(d), (i) and (ii) of the Indian Penal Code and section 67(A) of the IT Act.

As per the prosecution case, petitioner sent objectionable messages and pictures on the informant's mobile phone.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is handicapped and co-villager of the informant. Petitioner has claimed clean antecedent and he is in custody since 29.5.2021.

Patna High Court CR. MISC. No.57801 of 2021(2) dt.01-02-2022 2/2 Learned counsel appearing for the State and the informant oppose the prayer for bail. They submit that during course of investigation, mobile number in question has also been found to be registered in the name of the petitioner. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Sherghati Gaya in Gurua Police Station Case No. 114 of 2021.
