JUSTICE PARTHA SARTHY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 18-07-2024 The prayers in the writ petition are ambitious and misconceived. The petitioner seeks to direct the respondents to increase the number of seats in the courses of M.B.B.S., M.S. and M.D. nationwide and also seeks admission to M.B.B.S. courses in the private as well as Government Medical Colleges of those persons who obtained 50 per cent marks in NEET.

2. The medical education in the country is regulated by the National Medical Commission, a statutory authority comprising of experts who decide the recognition of Medical Colleges and the number of seats to which admissions can be made. The decision so taken is dependent upon not merely the need for doctors but the infrastructure available, the faculty position and so on. This Court would not venture to issue directions to increase the number of seats in the medical courses as has been sought for when there is an expert body entrusted with the task.

3. As far as admissions, again there is a National Testing Agency which has to decide the manner of admissions

4. We are of the firm opinion that no Public Interest Litigation can be filed on the above aspects. The writ petition stands dismissed.
