Petitioner seeks bail in a case under Sections 395 and 397 IPC. The F.I.R. is against unknown. The petitioner was guard of the house of the informant. The name of the petitioner figured in the confessional statement of Hare Ram Choudhary and Kamal Yadav. It appears that except the confessional statement of co-accused, the police did not collect tangible evidence to show the involvement of the petitioner, who is in jail since 19.12.2014.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S.Case No.793 of 2014.
