JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. At the very outset, it is pointed out on behalf of the petitioners that petitioner no. 1 has already been granted privilege of bail by the learned court below under Section 167 (2) of the Cr.P.C. and so far as rest two petitioners are concerned, they are not named in the FIR, but in course of investigation it came to light that a quarrel had taken place between the deceased and others including aforesaid petitioners and in that quarrel coaccused Sanjay Singh opened fire on the deceased as a result thereafter the deceased died.
Considering the aforesaid facts as well as taking note of
Patna High Court Cr.Misc. No.5123 of 2016 (2) dt.12-02-2016 2/2 the materials mentioned by the learned court below in impugned order, let petitioner nos. 2 namely Chandan Singh and petitioner no. 3 namely Rakesh Singh are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Raghunathpur P.S. Case No. 118 of 2013.
So far as petitioner no. 1 namely Kamleshwar Singh is concerned, his prayer for bail stands dismissed being infructuous. (Hemant Kumar Srivastava, J.) KKSINHA/- U T
