The petitioner apprehends his arrest in connection with Ara Muffasil P.S. Case No. 130 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016, pending in the court of Special Judge, Excise Act, Bhojpur, Ara. The accusation is that on receiving secret information about keeping the illicit liquor by the petitioner in his Poultry Farm situated in village Sundarpur Kuriya, the informant and other police personnel reached there. On seeing the police party, one person succeeded to flee away but the Choukidar disclosed the name of this petitioner, who fleeing away from his Poultry Farm. On search, 49 bottles each
Patna High Court CR. MISC. No.44468 of 2019(2) dt.19-07-2019 2/2 containing 375 ml Indian made foreign liquor were recovered. Learned counsel for the petitioner submits petitioner was not apprehended at the spot, from where, alleged Indian made foreign liquors are said to be recovered. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
