Petitioners are apprehending arrest in connection with Hajipur Sadar P.S. Case No. 329 of 2017 for the offence under sections 414, 406, 440/34 of the Indian Penal Code and section 7 of the Essential Commodities Act and 4/5 of the Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act.
From perusal of the FIR, it appears that the petitioners and three others have been named in the written complaint by the Block Supply Officer that they were involved in illegal storage of food grains for the purpose of black marketing. Out of five persons named in the FIR, the co-accused Bipin Kumar named in the FIR has been granted anticipatory bail by
Patna High Court Cr.Misc. No.7351 of 2018(2) dt.17-02-2018 2/2 this court in Cr. Misc. No. 62296 of 2017 vide order dated 4.1.2018.
Since the allegation against the petitioners are identical and as such on the ground of parity, the court is inclined to grant anticipatory bail to the petitioners, let the petitioners named above in the event of surrender/arrest before the court below within a period of one month on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 329 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
