JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-08-2021 Heard learned Counsel for the parties concerned. The petitioner has filed this writ application challenging the orders, dated 01.09.2020 and 12.12.2020, passed by the Executive Officer, Nagar Parishad, Danapur, whereby the building constructed by the petitioner has been declared illegal and the authority had ordered for its demolition. Learned Counsel for the petitioner submits that this writ application was filed before this Court because the Bihar Municipal Building Tribunal, Patna, was not functioning. However, now, the Tribunal has been constituted and has started working. Accordingly, learned Counsel for the petitioner seeks permission to withdraw this writ application with liberty to pursue his appeal, bearing Appeal No. 5 (S) 2020. Permission is granted.
