JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 I.A. No. 734 of 2015 has been filed for grant of provisional bail since the mother of the petitioner died on 02.05.2015. Death certificate has been brought on record as Annexure-21 of the I.A. application.

The petitioner is languishing in jail since 10.09.2014 in a case registered for the offences punishable under Section 379 of the Indian Penal Code, subsequently Section 392 IPC was also added.

It is alleged that the informant's `95,000/- was robed while travelling in the auto rickshaw, subsequently, the petitioner was apprehended from Jehanabad and from his possession `22,000/- was recovered.

It is submitted by learned counsel for the petitioner that only on suspicion, the petitioner was roped in the present case.

Patna High Court Cr.Misc. No.12671 of 2015 (2) dt.11-05-2015 2/2 Recovered money is not the robed money, it was the money given by the company in which the petitioner is employed and the recovered money has not been put on T.I. parade. The investigation has already concluded. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Kotwali P.S. Case No. 495 of 2014.
