JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Vijaipur P.S. Case No. 49 of 2019, corresponding to G.R.No. 861 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 447, 504 and 34 of the Indian Penal Code pending in the court of Additional Chief Judicial Magistrate-IV, Gopalganj. Allegation against the petitioner is of stabbing the father of informant by knife and causing injury on his neck, due to which he became unconscious and it further appears that he was taken to Referal Hospital, Bhore, from where he was referred to Sadar Hospital, Gopalganj for better treatment. Submission of learned counsel for the petitioner is that there is case and counter case between the parties and petitioner has also received injury and he is aged 70 years.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered and, if possible, to be disposed of on the same day.
With the above observation, this application is dismissed.
