The petitioner seeks bail in Baliya P. S. Case No. 114 of 2019 instituted for the offence under Section(s) 363 and 354A of the Indian Penal Code and Section 4 of the POCSO Act.

It is alleged that informant with his grandfather was given lift by this petitioner on motorcycle. It is further alleged that after going ahead about 5 km the grandfather of the informant got down from the motorcycle. The petitioner took the informant with him on motorcycle to his sister's house. It is further alleged that petitioner brought the informant to Maize field and tried to misbehave with her.

In this manner, there is general and omnibus

Patna High Court CR. MISC. No.44966 of 2019(2) dt.24-07-2019 2/2 allegation has been levelled against this petitioner. Petitioner is in custody since 11.4.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 1sth Addl. Sessions Judge cum Spl. Judge POCSO Act, Begusarai in connection with Baliya P. S. Case No. 114 of 2019 POCSO case no. 26 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
