2. The petitioner seeks regular bail in Sessions Trial No. 233 of 2024 arising out of Tekari P.S. Case No. 469 of 2023 registered for the offence punishable under Section-392 of the Indian Penal Code.

3. It is alleged that in course of proceeding towards Gaya by his tempo, in the way, three persons stopped the informant and forcibly got inside the tempo. It is further alleged that the accused persons assaulted the informant and took away his tempo.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated

Patna High Court CR. MISC. No.51863 of 2024(2) dt.30-07-2024 2/2 in this case. The petitioner is not named in the FIR and the police arrested him merely on suspicion and forcibly took his confession. No TIP was done and merely for having criminal antecedent, the petitioner has been made accused in the present case. The petitioner is in custody 08-08-2023.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as period of custody for about one year, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeXVI, Gaya in connection with Sessions Trial No. 233 of 2024 arising out of Tekari P.S. Case No. 469 of 2023 with condition that the petitioner shall appear in the court on each and every date till framing of charge.
