JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased who died in other than normal circumstances within five years of her marriage. There is accusation of illegal demand as well as torture against the petitioner and his other family members. The impugned order reveals that the trial of the petitioner has already been commenced and up till now five prosecution witnesses including the informant of the present case have been examined and the case is pending for recording the deposition of doctor and investigating officer.

Taking note of the aforesaid fact as well as stage of the case, I am not inclined to release the petitioner on bail and,

Patna High Court Cr.Misc. No.3430 of 2016 (2) dt.03-02-2016 2/2 hence, his prayer for bail in connection with Session Trial no. 153 of 2014 arising out of Jamo Bazar P.S.Case No. 96 of 2013, pending in the court of Additional Sessions Judge -IIIrd, Siwan stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible because petitioner is in jail custody since 23.09.2013. (Hemant Kumar Srivastava, J) N.K/- U T
