JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The name of the petitioner came in this case on the basis of mobile number given in the first information report and furthermore, it is alleged against the petitioner that it was petitioner who took the deceased from his shop and after that the dead body of the decease was recovered.

Contention on behalf of the petitioner is that according to prosecution case itself, deceased left the house of his daughter in the company of the petitioner and Deepu Sharma and subsequently, in course of investigation, some witnesses claimed to have seen the petitioner, Deepu and deceased taking wine and subsequently, the dead body of the deceased was recovered.

It is pointed out on behalf of the petitioner that having more or less similar allegation, co-accused Deepu Sharma has already been granted privilege of bail and as a matter of fact the deceased was friend of the petitioner and on the request of the deceased, the petitioner took the deceased to the house of his daughter from where deceased and Deepu Sharma proceeded. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Rohtas at Sasaram in connection with Dinara P.S.
