JUSTICE SATYAVRAT VERMA ORAL ORDER 07-03-2022 Heard learned counsel for the petitioner and Mr. Uday Chand Prasad, learned A.P.P. for the State. The petitioner seeks bail in connection with Forbesganj P.S. Case No. 483 of 2021 instituted for the offences under Sections 3(ii)(a)(b), 4,5 and 7 of the Immoral Traffic (Prevention) Act, 1956.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.07.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and the informant alleges that she received information regarding running a prostitution at City Rest House near station Chawk, which belongs to Bablu Jaiswal, accordingly, rest house was raided and the petitioner who worked in the rest house was not able to give any proper information regarding customer,

No.58307 of 2021(2) dt.07-03-2022 2/3 accordingly, the room was searched and two women namely, Chandni Kumari and Dulari Khatoon were found in different room and Chandni Kumari disclosed that she was staying in the room for two days and Dulari Khatoon disclosed that she was called for some work. It is alleged that name of the customers were not found in the register.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case and from perusal of the allegation as alleged in the First Information Report, it would manifest that apart from two women who were present in the room were only found and no males were found along with them, as such, it cannot be alleged that the racket of prostitution was going on though some irregularity in maintaining the register of the rest house may have been committed.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.07.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like
