JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 25.07.2014 in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.

It is alleged that the husband of the informant being a Home Guard constable was posted at Motihari post office who used to oppose his fellow constables having relationship with some women as a result he was being killed.

It is submitted by learned counsel for the petitioners that admittedly there is no eye-witness to the occurrence and considering the suspicious nature of accusation similarly situated co-accused Laxman Singh has been granted bail by this Court vide Cr. Misc. No. 2538 of 2015. A statement has been made in para 3

Patna High Court Cr.Misc. No.7472 of 2015 (2) dt.02-03-2015 2/2 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners, be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Town P.S. Case No. 268 of 2014.
