The petitioner is in custody since 31.07.2020in connection with Atri P.S. Case No. 144 of 2019 registered for the offences punishable under Sections 341/323/324/307/379/ 504/506/34 of the Indian Penal Code.

As per the prosecution case, on 04.02.2019, while the informant was sitting on his door along with his family, this petitioner along with other F.I.R. named accused persons abused them and also assaulted the informant and his wife with iron-rod, as a result of which, they sustained head injury and admitted to the hospital.

It is submitted on behalf of the petitioner that admittedly there is land dispute between the parties. The injuries are simple and caused by hard and blunt substance. Petitioner

Patna High Court CR. MISC. No.4366 of 2021(2) dt.22-03-2021 2/2 has got clean antecedent. Chargesheet has already been submitted in this case and he is in custody since 31.07.2020. Considering the aforesaid facts and circumstances, the bail petition of the petitioner is allowed. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, XIII, Gaya, in connection with Atri P.S. Case No. 144 of 2019, subject to following conditions:- (1)Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court on his absence on two consecutive dates without sufficient reason, his bail-bonds shall be cancelled by the Court below.

(2) If the petitioner tempers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
