JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-04-2015 Petitioner is languishing in custody since 08.10.2014 in a case registered for the offences punishable under Sections 379, 420 of the I.P.C.

It is alleged that someone exchanged the ATM card of the informant while he had some difficulty in drawing the amount and thereafter Rs. 50,000/- was transferred to the amount of the petitioner in three transactions through ATM card of the informant. It is submitted that as soon as the petitioner came to know that in three transactions of Rs. 15,000/-, 15000/- and 9500/- the money was credited in his account and the same was debited on the same day the Bank was informed. Hence, only on suspicion the petitioner has been roped in the present case.

Considering the nature of accusation and

Patna High Court Cr.Misc. No.13092 of 2015 (2) dt.03-04-2015 2/2 the fact that investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar, Motihari, East Champaran in connection with Trial No. 6157 of 2014, arising out of Motihari Town P.S. Case No. 576 of 2014.
