This application for anticipatory bail arises out of Sahiara P.S. Case No. 12 of 2016, disclosing offences under Sections 341,323,307,504,506,379/34 of the Indian Penal Code. Learned counsel for the petitioner has made two submissions. He has submitted that two other co-accused persons, namely, Chiranjivi Mishra and Gyanendra Mishra have been granted anticipatory bail by this Court by order, dated 21.04.2017, passed in Cr. Misc. No. 17502 of 2017. He has further submitted that Police, upon investigation have submitted final report finding no material against the petitioner. Considering the above submission, this application is allowed.

No.47095 of 2017(4) dt.22-12-2017 2/2 Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateV, Sitamarhi in Sahiara P.S. Case No. 12 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
