Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-08-2021 Heard Mr. Siddharth Prasad, learned advocate for the petitioner and Mr. Upendra Kumar, learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Digha P. S. Case No. 463 of 2020, dated 31.08.2020, instituted for the offences under Sections 341, 323, 354B, 379, 504, 506 and 34 of the Indian Penal Code.

The informant is said to have been abused, assaulted and divested of his personal belongings. The learned advocate for the petitioner has submitted that the accusation is absolutely false. The

Patna High Court CR. MISC. No.3834 of 2021(2) dt.04-08-2021 2/3 reason for falsely implicating the petitioner is that the informant was married to the daughter of one Ranjay Kumar. The marriage was not successful because of the drinking habit of the informant. Despite this, the informant always visited the house of Ranjay Kumar late in the night and displayed drunken behaviour. The petitioner is also a person residing in the same locality who protested and on his blowing of the whistle, many persons of the neighbourhood also arrived. Angered by this, the present case has been lodged by the informant who is a Journalist. No one is said to have been injured in the occurrence and the accusation does not appear to be probable.

For the reasons afore-stated and taking into account the fact that the petitioner does not have criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his
