2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504 of the Indian Penal Code.
3. As per prosecution case, petitioner is alleged to have assaulted the informant and her daughter by means of lathi as a result of which they sustained injuries.
4. It is submitted on behalf of the petitioner that due to land dispute between the parties an altercation took place in which both sides sustained injuries. Case and counter case. Injury caused by the petitioner is simple in nature. Petitioner claims clean antecedent.
5. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.52425 of 2023(3) dt.08-11-2023 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of I Learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P. S. Case No. 169 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
