The petitioner seeks bail in a case instituted for the offences under Sections 25(1-a)B, 26 and 35 of the Arms Act. Prosecution case, in short, is that one country made pistol along with five live cartridges were recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.12.2018 and has got no criminal antecedent. Charge-sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. No recovery of arms is made from the possession of the petitioner. It is alleged that one country made pistol along with five live cartridges were recovered. Arms

Patna High Court CR. MISC. No.44550 of 2019(3) dt.27-09-2019 2/2 were recovered from the possession of co-accuseds. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Tanveer Kaur, J.M. 1st Class, Patna in connection with Hawai Adda P.S. Case No. 287/18.
